                               <\/a>\n                            <\/li>\n<\/ol><\/div>\n<\/div>\n<\/div>\n<\/section>\n<section class=\"wp-block-text-block wp-block wp-block-text-block--reduced-width layout--none-top layout--spacing-l-bottom bg--white\">\n<div class=\"wp-block-text-block__container wysiwyg fade-in\">\n<p class=\"paragraph-xlarge\"><span class=\"large\">El Tribunal Superior de Justicia de Catalu\u00f1a (TSJC), en su sentencia <strong>n\u00ba 1357\/2024, ha reiterado que las funciones inspectoras en el Impuesto sobre Actividades Econ\u00f3micas (IAE) deben ser ejercidas exclusivamente por funcionarios p\u00fablicos. <\/strong>La resoluci\u00f3n, que afecta a inspecciones realizadas por el Ayuntamiento de Barcelona (en procedimientos referidos a clientes de Ayming), anula varias liquidaciones y sanciones al constatar que el procedimiento se bas\u00f3 en actuaciones llevadas a cabo por personal de una empresa subcontratada.<\/span><\/p>\n<p>En concreto, el TSJC analiza el caso de varias inspecciones realizadas a trav\u00e9s de la entidad Colaboraci\u00f3n Tributaria S.A., en las que se constata que personal externo particip\u00f3 activamente en tareas propias de la funci\u00f3n inspectora: levantamiento de actas, visitas a instalaciones, medici\u00f3n de elementos tributables como la potencia instalada y elaboraci\u00f3n de propuestas de regularizaci\u00f3n. Todo ello se realiz\u00f3 sin la intervenci\u00f3n de funcionarios habilitados, lo que, seg\u00fan el tribunal, constituye un ejercicio ilegal de potestades p\u00fablicas.<\/p>\n<p>El tribunal entiende que estas actuaciones exceden las tareas de asistencia t\u00e9cnica o administrativa permitidas por el art\u00edculo 169.2 del Reglamento General de las actuaciones y los procedimientos de gesti\u00f3n e inspecci\u00f3n tributaria (RD 1065\/2007), que \u00fanicamente permite delegar determinadas actuaciones en personal al servicio de la Administraci\u00f3n que no tenga la condici\u00f3n de funcionario. No puede, por tanto, atribuirse estas funciones a empresas privadas, ya que su intervenci\u00f3n vicia de nulidad todo el procedimiento inspector.<\/p>\n<p>Como consecuencia de esta sentencia, se han producido ya devoluciones relevantes a empresas afectadas por estas actuaciones, como es el caso de <a href=\"https:\/\/www.bauhaus.es\/\" target=\"_blank\" rel=\"noopener\"><strong>Bauhaus<\/strong><\/a>, que ha recuperado m\u00e1s de 634.000 euros correspondientes al ejercicio 2016, distribuidos entre sus sociedades Werkhaus y H\u00e1galo S.A. Asimismo, otras compa\u00f1\u00edas como <a href=\"https:\/\/www.seat.es\/\" target=\"_blank\" rel=\"noopener\"><strong>SEAT<\/strong><\/a> o <strong><a href=\"https:\/\/www.audi.es\/es\/\" target=\"_blank\" rel=\"noopener\">Audi<\/a> <\/strong>mantienen abiertos procedimientos similares, tambi\u00e9n referidos a inspecciones realizadas sin participaci\u00f3n de funcionarios p\u00fablicos.<\/p>\n<h2><strong>\u00bfC\u00f3mo afectan estas sentencias a las inspecciones del IAE?<\/strong><\/h2>\n<p>Este tipo de resoluciones judiciales <strong>abre un nuevo escenario para las empresas<\/strong> que hayan sido objeto de inspecciones similares. En muchas ocasiones, las compa\u00f1\u00edas no son conscientes de si los procedimientos en los que han sido implicadas se han llevado a cabo conforme a la legalidad. La colaboraci\u00f3n externa, aunque permitida para tareas t\u00e9cnicas y administrativas, <strong>no puede sustituir la funci\u00f3n inspectora<\/strong>.<\/p>\n<p>A ra\u00edz de estas sentencias, numerosas empresas est\u00e1n revisando sus expedientes del IAE, especialmente en aquellos municipios donde se han subcontratado estos servicios. <strong>Las inspecciones que incluyeron personal externo sin la intervenci\u00f3n de funcionarios pueden ser nulas<\/strong>, lo que da lugar a la posibilidad de recuperar importes ya abonados e incluso sanciones.<\/p>\n<h3><strong>La revisi\u00f3n del IAE: clave para evitar errores y detectar oportunidades<\/strong><\/h3>\n<p>El IAE es uno de los tributos m\u00e1s complejos del sistema fiscal local, especialmente por la variedad de ep\u00edgrafes, elementos tributables (como superficie, personal o potencia instalada), y la abundante jurisprudencia y doctrina existente. La correcta liquidaci\u00f3n de este impuesto requiere un conocimiento t\u00e9cnico profundo, m\u00e1s a\u00fan en sectores como el de la automoci\u00f3n, qu\u00edmica, food, log\u00edstica o distribuci\u00f3n etc., donde cada par\u00e1metro tiene un impacto directo en la cuota.<\/p>\n<p>En este contexto, <strong>la labor de revisi\u00f3n y an\u00e1lisis t\u00e9cnico se convierte en una herramienta clave para las empresas<\/strong>.
