Aunque su c\u00e1lculo depende de m\u00faltiples par\u00e1metros, una revisi\u00f3n especializada de estos permite detectar errores, sobredimensionamientos o incoherencias que incrementan la cuota de forma innecesaria.<\/p>\n<p>En Ayming contamos con un <a href=\"https:\/\/www.ayming.es\/advisory-compliance-fiscal\/impuestos-locales\/iae\/\">equipo experto en fiscalidad local y optimizaci\u00f3n del IAE<\/a>, que analiza en detalle los elementos tributarios, la calificaci\u00f3n de las actividades, los coeficientes aplicables y las ordenanzas municipales. A continuaci\u00f3n, presentamos las cuatro grandes v\u00edas de optimizaci\u00f3n que permiten generar ahorros directos y sostenidos para las compa\u00f1\u00edas.<\/p>\n<h2><strong>1. Revisi\u00f3n de la base imponible del IAE: elementos tributarios y clasificaci\u00f3n de actividades<\/strong><\/h2>\n<p>La base imponible para el pago del IAE est\u00e1 constituida por los elementos tributarios y la correcta clasificaci\u00f3n de la actividad. Por tanto, la primera v\u00eda de optimizaci\u00f3n consiste en revisar la configuraci\u00f3n de estos par\u00e1metros y asegurar que todos los factores f\u00edsicos, jur\u00eddicos y econ\u00f3micos empleados por la Administraci\u00f3n son correctos.<\/p>\n<p>En particular, resulta imprescindible revisar:<\/p>\n<ul>\n<li><strong>Superficies del local.<\/strong> Medici\u00f3n y determinaci\u00f3n de usos, zonas comunes, afecci\u00f3n a las actividades.<\/li>\n<li>Obreros (solo aplicable en la Comunidad Aut\u00f3noma en <strong>Navarra<\/strong>). Determinaci\u00f3n correcta de este elemento tributario seg\u00fan la Regla 14\u00aa de la Instrucci\u00f3n de las Tarifas del IAE de Navarra.<\/li>\n<li><strong>Potencia instalada.<\/strong> Revisi\u00f3n del elemento tributario de Potencia Instalada conforme a la Regla 14.1 A), a la doctrina administrativa, jurisprudencia y al entendimiento t\u00e9cnico del proceso industrial.<\/li>\n<li><strong>Clasificaci\u00f3n y calificaci\u00f3n de las actividades.<\/strong> Determinaci\u00f3n del ep\u00edgrafe y\/o grupo m\u00e1s adecuado, conforme al encaje real de la actividad, la normativa, la jurisprudencia y las consultas de la DGT.<\/li>\n<\/ul>\n<p>Una revisi\u00f3n rigurosa de estos elementos suele permitir ajustes relevantes en la Cuota M\u00ednima del IAE, y, en consecuencia, una reducci\u00f3n directa y permanente de la cuota del IAE en ejercicios futuros.<\/p>\n<h2><strong>2. An\u00e1lisis de los coeficientes de ponderaci\u00f3n, situaci\u00f3n y recargo provincial<\/strong><\/h2>\n<p>M\u00e1s all\u00e1 de los elementos tributarios, una segunda v\u00eda de optimizaci\u00f3n consiste en revisar los coeficientes municipales y supramunicipales que afectan a la cuota:<\/p>\n<ul>\n<li><strong>Estudio y an\u00e1lisis de los coeficientes de ponderaci\u00f3n, de situaci\u00f3n y del Recargo Provincial:<\/strong>\n<ul>\n<li>Coeficiente de ponderaci\u00f3n en funci\u00f3n del INCN (Importe Neto de la Cifra de Negocios).<\/li>\n<li>Coeficiente de situaci\u00f3n y\/o \u00edndice de situaci\u00f3n y categor\u00eda fiscal de las calles donde se ubican los locales.<\/li>\n<li>Comprobaci\u00f3n del Recargo Provincial.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>Esta v\u00eda es especialmente relevante porque puede permitir no solo reducir la cuota futura del pago del IAE, sino tambi\u00e9n recuperar cuotas indebidas de ejercicios no prescritos, generando un retorno econ\u00f3mico directo para las empresas.<\/p>\n<h2><strong>3. Aplicaci\u00f3n de exenciones y bonificaciones en el pago del IAE<\/strong><\/h2>\n<p>La tercera v\u00eda de optimizaci\u00f3n se basa en el estudio de exenciones y bonificaciones estatales y municipales que, en muchos casos, no est\u00e1n siendo aplicadas correctamente.<\/p>\n<p>Destacan:<\/p>\n<ul>\n<li>Estudio de posibles exenciones y bonificaciones previstas en la <strong>normativa estatal<\/strong> (art. 82 y 88 del Texto Refundido de la Ley Reguladora de las Haciendas Locales) y en las ordenanzas municipales. Por ejemplo: exenci\u00f3n por inicio de actividad, por no superar el l\u00edmite impuesto del INCN, bonificaciones por incremento de plantilla, utilizaci\u00f3n de energ\u00edas renovables, etc.<\/li>\n<li>Revisi\u00f3n de la <strong>situaci\u00f3n actual del local<\/strong> y actividad para verificar el cumplimiento de los requisitos.<\/li>\n<li>Verificaci\u00f3n del <strong>cumplimiento de requisitos.<\/strong> Revisi\u00f3n de la situaci\u00f3n del local y la actividad para asegurarse de su cumplimiento y de la correcta aplicaci\u00f3n de los beneficios fiscales disponibles<\/li>\n<\/ul>\n<h2><strong>4. Revisi\u00f3n de las Ordenanzas Municipales del IAE<\/strong><\/h2>\n<p>La cuarta v\u00eda de optimizaci\u00f3n consiste en analizar las <strong>Ordenanzas Fiscales Reguladoras del IAE de cada municipio<\/strong> para verificar que se ajustan plenamente a la normativa estatal y a los principios constitucionales.<\/p>\n<p>Una ordenanza que no se ajuste a Derecho puede abrir la puerta a impugnaciones o devoluciones.<\/p>\n<h3><strong>Cuota del pago del IAE: una herramienta estrat\u00e9gica para reducir costes fiscales<\/strong><\/h3>\n<p>La revisi\u00f3n del IAE es una oportunidad real para disminuir la carga fiscal, corregir incoherencias y obtener devoluciones de ejercicios anteriores.
