Esto implica que, adem\u00e1s del reporte de datos, surge la obligaci\u00f3n financiera de adquisici\u00f3n de certificados.<\/span><\/p>\n<p><span class=\"ui-provider a b c d e f g h i j k l m n o p q r s t u v w x y z ab ac ae af ag ah ai aj ak\" dir=\"ltr\">Si has importado algunos de los siguientes productos, regulados en los Anexos I y II del Reglamento (UE) 2023\/956, podr\u00edas estar obligado a presentar un informe trimestral CBAM (se presenta en abril, julio, octubre y enero):<\/span><\/p>\n<ul>\n<li>Cemento<\/li>\n<li>Fertilizantes<\/li>\n<li>Aluminio<\/li>\n<li>Hidr\u00f3geno<\/li>\n<li>Electricidad<\/li>\n<li>Hierro\/acero<\/li>\n<\/ul>\n<p>En caso de haber importado alguno de los productos arriba mencionados, deber\u00e1s presentar tu informe. Para ello, es necesario tener correctamente <a href=\"https:\/\/www.ayming.es\/insights-y-noticias\/noticias\/clasificacion-arancelaria\/\">clasificados arancelariamente los productos importados<\/a> ya que de ello depender\u00e1 estar o no afectado por esta regulaci\u00f3n.<\/p>\n<p><a class=\"btn btn--primary\" href=\"https:\/\/www.ayming.es\/consulta-cbam\/\" target=\"_blank\" rel=\"noopener noreferrer\">COMPRUEBA SI DEBES PRESENTAR EL CBAM<\/a><\/p>\n<h2><strong>\u00bfAfecta a las mercanc\u00edas importadas de cualquier pa\u00eds?<\/strong><\/h2>\n<p>Esta medida, en principio, afecta a las importaciones de las mercanc\u00edas arriba mencionadas de <strong>casi todos los pa\u00edses terceros<\/strong>, como, por ejemplo, China y Malasia.<\/p>\n<p>No obstante, ciertos pa\u00edses y territorios quedan excluidos del \u00e1mbito de aplicaci\u00f3n del CBAM por lo que <strong>determinar el origen correcto de las mercanc\u00edas es clave.<\/strong><\/p>\n<h2><strong>\u00bfQui\u00e9nes deben presentar el informe MAFC?<\/strong><\/h2>\n<p>Los responsables ser\u00e1n<strong> el importador o el representante aduanero indirecto. <\/strong>Solo los operadores con solicitud presentada o resoluci\u00f3n favorable del MITECO como <strong>Declarante Autorizado <\/strong>pueden validar sus informes y realizar el despacho de aduanas.<\/p>\n<p>Asimismo, se podr\u00e1 otorgar <strong>apoderamiento<\/strong> individualizado para el acceso al Registro CBAM a terceros, como Ayming.<\/p>\n<h2>Coste del MAFC<\/h2>\n<p>Desde la entrada del periodo definitivo del CBAM, en enero de 2026, cada tonelada de CO2 declarada tiene ahora un coste. La Comisi\u00f3n Europea ha fijado el primer precio oficial del certificado para el primer trimestre de 2026 en <b data-path-to-node=\"5,1,0\" data-index-in-node=\"266\">75,36 EUR<\/b>.<\/p>\n<h2><strong>\u00bfD\u00f3nde se debe presentar el informe CBAM?<\/strong><\/h2>\n<p>El informe debe ser presentado en el <a href=\"https:\/\/cbam.ec.europa.eu\/declarant\" target=\"_blank\" rel=\"noopener\">portal CBAM de la Uni\u00f3n Europea,<\/a> seleccionando la opci\u00f3n \u201cAduanas\u201d.<\/p>\n<h2><strong>\u00bfQu\u00e9 informaci\u00f3n debe contener el informe MAFC?<\/strong><\/h2>\n<p>Este informe debe contar con datos reales de emisiones de las instalaciones de origen. El uso de valores por defecto est\u00e1 ahora estrictamente limitado y requiere una justificaci\u00f3n t\u00e9cnica detallada seg\u00fan el Reglamento (UE) 2025\/2083.<\/p>\n<p>Adem\u00e1s debe incluir:<\/p>\n<ul>\n<li>Cantidad de mercanc\u00eda importada (Masa Neta).<\/li>\n<li>Identificaci\u00f3n del c\u00f3digo arancelario a 8 d\u00edgitos.<\/li>\n<li>Emisiones Directas e Indirectas de gases de efecto invernadero (\u201cGEI\u201d).<\/li>\n<li>Datos de proveedores e instalaciones.<\/li>\n<li>Otros datos.<\/li>\n<\/ul>\n<h3><strong>\u00bfEs posible modificar o completar el informe CBAM presentado? <\/strong><\/h3>\n<p>S\u00ed, un mes tras la fecha l\u00edmite de entrega del informe trimestral.<\/p>\n<h2><strong>\u00bfCu\u00e1les son las consecuencias de no presentar el informe trimestral MAFC?<\/strong><\/h2>\n<p>No presentar el informe o carecer de la autorizaci\u00f3n de Declarante Autorizado conlleva la suspensi\u00f3n del despacho aduanero. Las aduanas europeas tienen ahora potestad para bloquear la entrada de mercanc\u00eda CBAM si el operador no est\u00e1 regularizado.<\/p>\n<ul>\n<li>Importe de la<strong> sanci\u00f3n se situar\u00e1 entre 10 y 50 \u20ac por tonelada de emisiones<\/strong> no notificadas. La sanci\u00f3n se incrementar\u00e1 de acuerdo con el \u00edndice de precios de consumo europeo.
